These Terms of Service ("Terms") govern purchases and services provided through River Fade Studios. By accessing this website, purchasing a product, or purchasing or booking a service, you agree to these Terms.

1. Products and Orders

River Fade Studios offers products, including made-to-order products produced and fulfilled by third-party fulfillment providers.

All orders are subject to acceptance and availability. We reserve the right to cancel or refuse an order due to errors in pricing or product information, suspected fraud, inability to fulfill the order, or other reasonable circumstances. If we cancel an order after payment has been collected, the applicable payment will be refunded.

Product appearance, including color, may vary slightly due to differences in displays, printing processes, materials, and production.

2. Payment

Prices are displayed at the time of purchase. Applicable taxes, shipping charges, and other charges will be shown at or before checkout when required.

Payment must be successfully processed before an order is fulfilled or a photography service is considered confirmed unless otherwise agreed in writing.

3. Shipping and Fulfillment

Products may be manufactured and shipped by third-party fulfillment providers.

Any stated processing or delivery dates are estimates unless expressly identified as guaranteed. If an order cannot be shipped within the promised time, River Fade Studios will handle the delay, cancellation, and any required refund in accordance with applicable law.

Customers are responsible for providing accurate shipping and contact information.

4. Returns and Refunds

Returns, replacements, exchanges, and refunds for products are governed by our Return & Refund Policy, which is incorporated into these Terms.

Nothing in these Terms limits any rights that cannot legally be waived under applicable consumer protection law.

5. Photography Services

Photography services may include portrait, architectural, interior, real-estate, and related photography.

The specific scope of work, price, location, deliverables, and other project-specific terms may be established at the time of booking or through a separate written agreement.

Unless otherwise agreed, the client is responsible for obtaining any permissions reasonably necessary for photography to occur at the selected property or location.

Any cancellation, rescheduling, deposit, or refund terms disclosed when a photography service is booked become part of the agreement between the client and River Fade Studios.

6. Copyright and Use of Work

Unless expressly transferred in writing, River Fade Studios retains all copyrights and other intellectual-property rights in photographs, artwork, designs, graphics, and other original content created by River Fade Studios.

Purchasing a physical product does not transfer copyright or grant the purchaser the right to reproduce, distribute, resell, modify, or commercially exploit the underlying photograph, artwork, or design.

Photography clients receive only the usage rights expressly provided with their service or in a separate written agreement. Ownership of copyright is not transferred unless expressly stated in writing.

7. Website and Third-Party Services

Our store is hosted through Shopify and may rely on third parties, including payment processors, fulfillment providers, shipping carriers, and other service providers.

River Fade Studios is not responsible for interruptions or failures caused solely by third-party systems or services outside our reasonable control, except where responsibility cannot legally be excluded.

8. Limitation of Liability

To the fullest extent permitted by applicable law, River Fade Studios will not be liable for indirect, incidental, special, or consequential damages arising from use of this website, products, or services.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.

9. Intellectual Property of the Website

The River Fade Studios name, branding, photographs, artwork, designs, written content, and other original materials displayed on this website may not be copied, reproduced, distributed, sold, or commercially used without authorization, except as permitted by law.

10. Governing Law

These Terms are governed by the laws of the State of Colorado and applicable federal law, without regard to conflict-of-law principles.

11. Changes to These Terms

We may update these Terms from time to time. Changes will apply from the date the revised Terms are posted and will not retroactively alter rights or obligations arising from transactions completed before the change where prohibited by law.
